Judge rejects motion to change guilty plea

News Article - Posted Feb 26, 2000 - GOSHEN: Judge finds evidence does not support an involuntary intoxication defense in case where a youth is charged with manslaughter. An Orange County judge denied Jason McQuiston's motion to withdraw his guilty manslaughter plea yesterday, saying he didn't believe the evidence supported an "involuntary intoxication" defense. McQuiston said he was "involuntarily intoxicated" when he crashed a car that killed his 17-year-old passenger last summer. McQuiston, 21, had wanted his guilty plea to second-degree manslaughter withdrawn saying someone laced marijuana he consumed before the July 27, 1999, crash with PCP. Executive Assistant District Attorney David Huey said the sentencing, originally scheduled for yesterday, will be Monday. McQuiston was driving more than 80 mph at 2:50 a.m. when he rammed into a utility pole on Route 207. Front-seat passenger Jason Weyant, 17, of Newburgh, was pronounced dead at the scene. McQuiston and four other teen-aged passengers in the car suffered minor injuries. McQuiston was originally charged with second-degree manslaughter, criminally negligent homicide and second-degree vehicular manslaughter, felonies; and misdemeanor driving while ability impaired by drugs and reckless driving. Police said McQuiston was high on marijuana and driving 80 to 90 mph when he lost control of the car on Route 207 near Clarkview Road and crashed into a utility pole. Weyant's family wanted to speak at the sentencing, which is why the sentencing had to be rescheduled. McQuiston could get up to 12 years in prison. McQuiston submitted to blood tests last year that found traces of drugs. But in January, during his pre-sentence interview with probation, McQuiston said he consumed marijuana that had been laced with PCP, also known as angel dust, without his knowledge.
